Comprehensive Participant Waiver, Release of Liability, Voluntary Assumption of Risk, and Indemnity Agreement
Family/Group Waiver & Release of Liability

The Farm, 1162 W 3000 S, Hurricane, Utah 84737
This waiver applies to all activities, events, and attractions on the premises, including but not limited to:
– Farm & Agritourism Activities (animal interactions, petting zoo, camps, educational programs, hayrides, gardening, and general agritourism experiences)
– The Haunted House at The Farm
This waiver applies to all members of the family/group attending under the undersigned parent/guardian. By signing, you waive certain legal rights, including the right to sue, on behalf of yourself and all minors or dependents in your group.

1. Voluntary Assumption of Risk
I acknowledge that participation in activities at The Farm and Haunted House involves inherent and unanticipated risks, including but not limited to:
Farm & Agritourism Risks
Participation in farm and agritourism activities may expose guests to inherent and unpredictable risks, including but not limited to:
– Unpredictable animal behavior (biting, kicking, ramming, scratching, stepping, etc.)
– Hazards of land, equipment, fences, and uneven terrain (mud, rocks, holes, vegetation, water features, irrigation systems)
– Use of recreational and play structures, including but not limited to:
– Parent-powered coaster, swings, ziplines, slides, and climbing structures
– Hamster wheels, corn pit, hay bale play areas, tunnels, and obstacle courses
– Tractors, wagons, pedal carts, and other farm or event equipment
– Allergens and environmental exposure (hay, dust, pollen, animals, insects, plants)
– Weather conditions and natural outdoor risks such as heat, cold, wind, or precipitation
– Contact with water or mud during play or farm chores
– Risk of illness, including zoonotic diseases and viruses such as COVID-19
– Slips, trips, or falls in barns, fields, event areas, or on any farm attraction
– Minor scrapes, bruises, or other injuries commonly associated with outdoor play and farm activities
Haunted House Risks
– Sudden noises, darkness, fog, flashing/strobe lights, confined spaces, and startling effects
– Emotional distress or fear responses due to actors, props, and atmosphere
– Slips, trips, or falls on uneven or obstructed walkways in low-light conditions
– Physical exertion (running, walking, sudden movements)
– I understand that actors are able to touch me
I understand and accept that participation in these activities may result in injury, illness, emotional distress, property damage, or death, and I freely and voluntarily assume all such risks on behalf of myself and/or my minor child.

2. Release of Liability
In consideration for being permitted to enter and participate, I voluntarily:
– Release and forever discharge The Farm, Fisher Family Farms, its owners, managers, employees, volunteers, agents, affiliates, and representatives (collectively the “Releasees”) from all liability for any injury, illness, death, or property damage arising from participation, whether caused by negligence of Releasees or otherwise.
– Agree not to bring any claims, demands, or lawsuits against the Releasees for any reason related to participation.
– Accept full financial responsibility for any loss, damage, or injury I or my child may cause to ourselves, others, animals, or property while on site.

3. Indemnification
I agree to indemnify and hold harmless the Releasees from any and all claims, damages, losses, and expenses (including attorney’s fees) resulting from participation by myself or my minor child in activities at The Farm or Haunted House.

4. Acknowledgement of Utah Agritourism Law
I understand that under Utah Code § 78B-4-512, an operator of an agritourism activity is not liable for injury or damage resulting from the inherent risks of such activities, provided proper warning signs are posted. I acknowledge that The Farm has posted such signs as required by law.

5. Rules of Conduct
I agree (and agree to ensure that my child agrees) to follow all posted rules and staff instructions, including:
– No roughhousing, running, climbing, or reckless behavior
– No entry into animal enclosures except under direct staff supervision
– No feeding, chasing, or handling animals outside of structured activities
– No weapons, alcohol, drugs, smoking, or open flames on premises
– No touching actors, props, or other guests in the Haunted House
– Helmets are recommended for horseback riding; participation is at own risk
– Staff may remove participants at any time for unsafe or inappropriate conduct, without refund

6. Health & Medical Condition
I certify that I (and/or my child) am physically and mentally fit to participate. I understand certain activities may not be safe for individuals with:
– Heart conditions
– Seizure disorders
– Asthma or respiratory issues
– Pregnancy
– Claustrophobia or sensitivity to flashing lights
I agree to participate only within personal physical limits and accept full responsibility for my own health and safety and/or that of my child.

7. Insurance & Responsibility
I represent that I have adequate medical and liability insurance to cover any injury, illness, or damage I or my child may sustain or cause. If not, I agree to personally bear all such costs.

8. Media Release
I grant permission for The Farm and Haunted House to use photographs, video, or recordings of me or my child taken on property for promotional purposes without compensation.

9. Severability & Governing Law
This waiver is intended to be as broad as permitted by Utah law. If any part of this agreement is found invalid, the remainder shall remain enforceable.

Parent/Guardian Acknowledgement
By signing below, I affirm that I am at least 18 years of age and the parent or legal guardian of the minor(s) listed on this form.
I certify that I have the full legal authority to sign this agreement on behalf of the listed minor(s) and to assume all risks, responsibilities, and obligations set forth herein.
I understand and agree that this document is a legally binding waiver and release of liability, and that by signing it, I am waiving certain legal rights for myself, my child(ren), and any other minors under my care.
I accept all terms of this agreement on behalf of myself, my minor child(ren), and our family or group.
